Position Title: Senior Specialist, Legal Service and Enforcement
Job Grade: – 09
Duty Station: – Addis Ababa/Head Office
Availability: – As soon as possible
Job Purpose:
– The purpose of this position is to assist the Manager in the divisional operation; provide legal advice to the management and functional units on administrative issues, agreements, negotiations and working manuals, labor relations; defend the right of the Exchange before court of law, different judicial or administrative organ; review and incorporate inputs on drafted operational and administrative policies, procedures, rules and regulations designed by different functional units from legal perspective and ensure its alignment; participate in the development of annual divisional plans and ensures its implementation; produce periodic reports.
SUMMARY OF MAJOR DUTIES AND RESPONSIBILITIES
- Participates in the development and revision of policies, procedures, and manuals of the Division;
- Conducts research and analysis regarding laws applicable to the Exchange to identify issues that need the introduction of new rules or amendment of the Rules; drafts Rules of the Exchange, operational contracts, and presents them to appropriate bodies for approval;
- Provides legal consultations, comments, advice, and interpretation on issues related to the Rules of the Exchange and other pertinent laws applicable to the Exchange operation to different Departments/Divisions of the Exchange.
- Engages in the development of strategy, arguments, and testimonies in preparation for presentation of case before courts of law or other judicial or quasi-judicial institutions;
- Gathers all necessary evidence to formulate a defense or to initiate legal action to defend the interests of the Exchange;
- Prepares responses to requests made by courts and law enforcement agencies;
- Prepares recommendations on action to be taken on legal issues that concern the Exchange to prevent or avoid unnecessary litigation and minimize cost and risks;
- Provides day-to-day legal advice and interpretations on administrative and operational issues as requested by the respective functional units of the Exchange;
- Oversees compliance with relevant laws and rules of the Exchange; follows up enforcement of the BCC disciplinary measures and reviews and forwards the reports to the Secretary of the BCC;
- Prepares investigation reports regarding rule violations and prepares responses to appeals made by members, clients of intermediary members, or floor representatives.
- Facilitates the awareness creation programs to members, employees of the Exchange, and other stakeholders concerning the Rules of the Exchange and other pertinent laws applicable to the Exchange;
- Reviews internal agreements and procedures, including those between warehouse operators, clearing institutions, members, and clients, to determine legality and compatibility with rules and regulations governing the Exchange;
- Prepares periodic reports concerning the activities of the Division; and
- Performs other duties assigned by the immediate supervisor.
