Call for Expression of Interest for Legal Service Provision
Action Against Hunger is an international non-profit humanitarian organization implementing relief, rehabilitation and development programs in different parts of Ethiopia Since 1985. Action Against Hunger has been registered with the Federal Democratic Republic of Ethiopia, charities and Societies under registration No. 0032.
Currently Action Against Hunger has a total staff of 680 and it is expanding program operations through working in partnership with other INGOS and local NGOs and directly working with refugee and host communities and their structures through coordination and its field offices.
Objectives of hiring a Legal Service Provider Company
Action Against Hunger is desirous of having an independent Legal Service Provider Company to ensure the necessary legal services on the areas of contract management, tax issues, personnel matters and other legal matters, that might arise on the day to day implementation of its activities, are provided in the best interest of the Organization.
Scope of the Legal Service
The Legal Advisor will provide all legal services, as stated here under duties and responsibilities, as the cases and issues might arise. The Legal Service Provider Company will avail themselves at Action Against Hunger premises and all locations where the cases require the Legal Service Provider Company physical presence.
Duties and responsibilities
- Advise Action Against Hunger Senior Management Team on all legal matters.
- Draft, review or revise various legal documents, including premises, framework agreements, staff, policies, program and other administrative contracts.
- Render legal advice and opinions to the County Director and other Managers as required.
- Review, refer and monitor potential litigations and act as liaison/representative on behalf of Action Against Hunger on all legal matters.
- Explain and interpret policies and activities; and resolve (provide advice/direction) sensitive, significant and controversial issues.
- Provide advice on personnel, administrative and program contract matters and represent Action Against Hunger during personnel litigations and hearings at Court of Law, Labour Office etc.
- Appear before Courts and administrative proceedings to represent Action Against Hunger as required.
- Attend and litigate at depositions, administrative hearings and Court as necessary.
- Monitor and assist with written Occupational Safety and Health Administration and required safety plans as well as HR Manual.
- Analyse and review contracts and provide legal opinions and recommendations to ensure Action Against Hunger is properly and effectively represented in such matters.
- Respond to and resolve difficult and sensitive inquiries and advice on internal disciplinary issues suggesting decision.
- Review and respond to all forms of employment claims upon request
- Act as liaison with external attorneys on legal matters.
- Continuously follow up any change/amendment in legal issues and timely
- Inform Action Against Hunger about the implications.
- At all times act in the best interest (and protection) of Action Against Hunger
About You
Essential Qualifications
Knowledge of:
- Principles and applications of labour, contract laws, local government, employment, tax and administrative laws.
- Charities and societies rules, regulations and procedures
- Major Donors’ Contract procedures
- Operational characteristics, services and activities of law enforcement.
- Evidenced administrative, civil, judicial and criminal procedures and rules experience.
- Fundamentals of litigation and alternative dispute resolution procedures including litigation in trial court.
- Pertinent Federal, Regional, and local laws, codes and regulations.
- INGO duties, powers, limitations, and authority
Ability to:
- Represent Action Against Hunger in a wide variety of labour, civil, criminal, and administrative proceedings.
- Interpret and make decisions in accordance with laws, regulations, and policies.
- Present statements of law, fact and argument clearly and logically.
- Apply skills and concepts involved in problem solving including identifying and diagnosing the problem, generating alternative solutions and strategies, implementing the plan, and keeping the planning process open to new information and new ideas.
- Apply skills and concepts involved in legal analysis and reasoning including identifying and formulating legal issues; formulating relevant legal theories, elaborating legal theory, evaluating legal theory, and criticizing and synthesizing legal argumentation.
- Evaluate the likely practical consequences of given legal strategies.
- Exercise good judgment, flexibility, creativity, and sensitivity in response to changing situations and needs.
- Communicate clearly and concisely, both orally and in writing on daily, weekly and monthly basis.
Experience and Trainings
More than 10 years of responsible professional legal experience in the areas of labour, contract law, tax law, employment law, charity law and extensive knowledge of Federal and regional government laws.
- At least 5 years’ experience in providing legal services to similar International NGOs on matters mentioned in duties and responsibilities.
